Wild camping on the Hochstollen: one of the few Swiss summits where the law says yes

Almost every legal answer in these reports is an absence: nobody wrote a ban, so nothing forbids you. This one is different. Obwalden put the permission in a statute, in plain words, and a single night on the Hochstollen is lawful because the canton said so. The two things worth knowing are the word the statute uses and a line that runs 38 metres west of the summit.

What do these mean?

Illegal A specific rule bans it, usually with a fine, and it can be enforced. Sleep somewhere else.

Not allowed No real place to camp here. A gated site, a developed area, or nowhere sensible to lie down, even if no fine is attached.

It depends You can sleep here, but there's a condition first: ask the landowner, book a spot, stay inside a set zone, or use a bivvy instead of a tent. The report says which.

Tolerated No rule clearly allows or bans it, but a single night is accepted in practice and nobody enforces against it. Normal for high bivouacs above the treeline.

Legal Camping one night is fine here. Either a rule allows it, or we checked every law and found nothing against it. Still: pitch late, leave early, no trace.

What "wild camping" means here: one night. A small tent or a bivvy bag, up towards evening, gone in the morning. Not a base camp, not a camper van. Most Swiss bans are written against camping; whether a single night also falls under them depends on the exact wording, so this article checks that wording. Here the wording is unusually helpful, because the statute itself is built around the single night. The full difference: wild camping vs bivouacking.

Obwalden put the permission in a statute, and that is rare

Wild camping on the Hochstollen is one of the few cases in this series where the answer does not depend on a gap in the law. It depends on a sentence somebody deliberately wrote.

The act is the Gesetz über das Campieren of 4 December 2014, GDB 971.4, in force since 1 March 2015. It is short, and it is built in two moves. Art. 6 sets the general rule, and it is a ban:

"Das Aufstellen von Zelten, Wohnwagen und Wohnmobilen zum Campieren ausserhalb behördlich bewilligter Campingplätze ist nicht gestattet."Gesetz über das Campieren, GDB 971.4, Art. 6 "Campieren ausserhalb von Campingplätzen · a. Grundsatz". Setting up tents, caravans and motorhomes to camp outside officially authorised campsites is not permitted.

Then Art. 8 carves the exception out of it, and this is the whole article in one sentence:

"Zum einmaligen Übernachten darf ein Zelt, ein Wohnwagen oder ein Wohnmobil ohne Bewilligung ausserhalb bewilligter Campingplätze aufgestellt werden, wenn keine öffentlichen oder privaten Interessen beeinträchtigt werden."Same act, Art. 8 "c. Einmaliges Übernachten", para. 1. For a single overnight stay a tent, caravan or motorhome may be set up without a permit outside authorised campsites, provided no public or private interests are impaired. Para. 2 adds that it is done at your own risk.

Read the marginal note, not just the sentence. Art. 8 is headed "Einmaliges Übernachten", a single overnight stay, and the operative words repeat it. This is not a permission to camp. It is a permission to sleep somewhere once. The moment you are there for a second night you are outside Art. 8 and back inside the Art. 6 ban, and Art. 11 punishes breaches of the act with a fine, singling out whoever "wiederholt gegen das Campingverbot ausserhalb eines Campingplatzes verstösst", repeatedly breaches the camping ban outside a campsite. The act itself sets no franc figure, so anyone quoting you a precise number for Obwalden is quoting something else.1

The elastic clause is real too. "Wenn keine öffentlichen oder privaten Interessen beeinträchtigt werden" is doing work. It is the hook a landowner or the commune would use if your night actually disturbed something: livestock, a hay meadow, a water catchment, other people. Up here on rock and alpine grass at 2'480 m, one small tent for one night is about as far from impairing anybody's interest as it gets. Down on the plateau it is a different picture, and the article comes back to that.1

One correction worth making, because the internet keeps repeating it. The Obwalden rule is often cited as GDB 971.41. That number is the Verordnung über das Kampieren of 25 February 1977, and it is ausser Kraft, repealed. The live act is 971.4. The substance survives either way, but if you are checking the text yourself, check the right one.1

The commune agrees, which matters because communes are where Swiss camping rules usually hide. Kerns runs an online counter page for "Campieren ausserhalb Campingplatz" and it restates the cantonal rule word for word, including the one-night exception. No stricter Kerns camping reglement turned up.6

The line 38 metres west, and which side of the top to be on

The summit point itself, LV95 2'661'092 / 1'180'556, 2'480.8 m, is clean. Queried on 5 August 2026: no federal hunting-ban district, no wildlife rest zone, no BLN landscape, no mire landscape, no fen, no raised bog, no floodplain. The only thing the national layers return at the pin is the commune, Kerns, canton Obwalden.2

Thirty-eight metres west, that changes. The cantonal wildlife rest zone Gibel - Kleines Melchtal (Nr. 17.1) has its boundary 38 m from the summit on a westerly bearing, and it covers the western and south-western flanks down into the Kleines Melchtal bowl. It is not advisory. The federal register carries it as rechtsverbindlich, legally binding, resting on RRB No. 283 of 21 January 2014 and the cantonal parliament's decision of 20 March 2014.3

What it actually forbids is worth reading precisely, because it is not camping. The zone carries rule R70: "Zutrittsverbot abseits der eingezeichneten Wege, Leinenpflicht", an access ban away from the marked paths plus a leash requirement, with a start and landing ban for aircraft including paragliders, parachutes and speedflyers. And it runs only from 1 December to 30 April. So in summer the zone imposes nothing on you at all, and in winter what it stops is not your tent but your leaving the marked route to reach a pitch. The practical effect is the same, which is why it is in the summary, but the mechanism is an access rule.3

So the honest instruction is a direction, not a distance. The zone was probed on eight bearings at 50, 100, 200 and 400 metres from the summit. West and south-west are inside it from 50 m out. South and north-west are clear to 200 m and inside at 400 m. North, north-east, east and south-east are clear at every radius out to 400 m. That is the Frutt side, the side you walked up from, and it is where the ground is friendlier anyway.2

Which gives the one-line rule for this summit: pitch east of the top, on the Melchsee-Frutt side. In summer it makes no legal difference and it is simply the better ground. Between 1 December and 30 April it is the difference between a lawful night and a binding access ban, and in that season you should be on the marked route to get there in the first place.23

The absolute ban is real, and it is in this same commune

An article that says "yes, it is legal" owes you the other half: where in this landscape the answer is a flat no. It is not far, and it is not in a different canton.

The federal hunting-ban district Hutstock, object no. 11, 3'502.9 hectares, an area with integral protection provisions, begins 4'483 metres north-east of the Hochstollen summit and lies in Gemeinde Kerns, the same commune as the summit. Inside it the federal ordinance is categorical:

"Das freie Zelten und Campieren ist verboten. Vorbehalten bleibt die Benutzung offizieller Zeltplätze. Die Kantone können Ausnahmen bewilligen."Verordnung über die eidgenössischen Jagdbanngebiete (VEJ), SR 922.31, Art. 5 para. 1 lit. e, consolidated version in force since 1 February 2025. Free tenting and camping are forbidden; the use of official campsites is reserved; the cantons may grant exceptions.

That ban does not care whose land it is. Cantonal permission is the only door, and it is not open for tourist bivouacs. It also does not care that Obwalden's Art. 8 says yes, because Art. 8 is cantonal and this is federal.4

The canton says the same thing in its own words. The Amt für Wald und Landschaft published a notice on 1 June 2025 after a run of violations, and it draws exactly the line this article draws. Outside protected areas: "Im Kanton Obwalden ist es grundsätzlich erlaubt, ein Zelt, einen Wohnwagen oder ein Wohnmobil für eine einmalige Übernachtung ausserhalb bewilligter Campingplätze aufzustellen." Inside them:

"In Schutzgebieten jedoch gilt ein absolutes Campierverbot. Hier sind das Campieren, Biwakieren sowie das Abstellen von Wohnmobilen ausdrücklich untersagt."Kanton Obwalden, Amt für Wald und Landschaft, notice of 1 June 2025. In protected areas an absolute camping ban applies; camping, bivouacking and parking motorhomes are expressly prohibited. Note that this wording catches bivouacking too, not only tents.

The notice names the areas it means: the Glaubenberg mire landscape with its hotspots at Mittaggüpfi and Blauer Tossen in Alpnach and Sewensee, Rickhubel and Jänzi in Sarnen; the hunting-ban districts, "e.g. Huetstock, Gemeinde Kerns"; nature protection zones such as the Wichelsee; and protected floodplains such as the Aue Laui in Giswil. Violators must expect a fine, and the notice quotes no figure either.5

None of those touch this summit. Measured against the actual polygon geometry rather than pin to pin: Hutstock 4'483 m to the north-east, the Schwarzhorn hunting-ban district 8'614 m to the south-west, the nearest mire landscape 8'872 m to the south-west, the nearest fen of national importance 1'503 m to the north-north-west. The Melchsee-Frutt basin is famous mire country and people reasonably worry about it; the fens are real, and they are far enough from the top that a pitch "a little below the summit on the Frutt side" cannot wander into one.2

Where to actually sleep, and why the plateau is a different question

The realistic pitch is just below the top on the Frutt side, east of the ridge. The summit itself is a narrow, exposed high point and there is no reason to sleep on it. Drop far enough east to be out of the wind, stay on rock and thin alpine grass rather than anything grazed or cut, and you are outside the rest zone by 400 m in the direction that matters. Carry your water: there is none up here, and the lakes are a long way down.2

The plateau below is not covered by the same reasoning, and this is the part people get wrong. Melchsee-Frutt is not empty land. It is a working alp with a named landowner, and the stakeholders there published a joint position: the Alpgenossenschaft a.d.st. Brücke Kerns as landowner, together with the tourism association, Gemeinde Kerns, Korporation Kerns, Sportbahnen Melchsee-Frutt and Bergsee-Fischen. Their line is on the resort's own information page in 2026 and it is one sentence:

"Eine Übernachtung bei der signalisierten Fläche bei der Talstation Balmeregg ist erlaubt."melchsee-frutt.com, guest information, read 5 August 2026. An overnight stay at the signposted area at the Balmeregg valley station is permitted. The stakeholders' original leaflet added "für eine Nacht", for one night, and "Das Übernachten erfolgt auf eigenes Risiko".

The same leaflet is blunt about what happens elsewhere on the plateau: "Widerhandlungen gegen das Campinggesetz vom Kanton Obwalden werden durch die Grundeigentümerin an die zuständige Strafbehörde zur Anzeige gebracht", breaches of the cantonal camping act are reported by the landowner to the prosecuting authority. That is not a second ban. It is the landowner announcing that they will use the elastic clause in Art. 8, the private interests one, and hand it to the authorities. On a grazed alp with a signposted alternative 500 metres away, that argument is not weak.7

So the plateau has a clean answer that costs you nothing: the signposted area at Talstation Balmeregg, one night, with a public toilet at the station. Leave it clean, go easy on the wood. If you want the summit night, take the summit night; if you are staying on the plateau, take Balmeregg rather than a spot of your own choosing.7

Two things I am not going to tell you. There is a persistent claim that a "Zeltplatz Tannalp" exists on the plateau. I found no evidence of it operating in 2026 and I am not going to send you to it. And the stakeholders' leaflet PDF, which is the fullest statement of the plateau rule, is no longer served by either of its old addresses; the sentence above survives on the live guest information page, and the leaflet itself only in the web archive. Courtesy, which is not law. The Alpine Club's leaflet is the standard worth following here, and it lands close to what Obwalden legislated:

"Ansonsten ist eine einzelne Übernachtung einer kleinen Anzahl Personen im Gebirge oberhalb der Waldgrenze in der Regel unproblematisch, wenn sie rücksichtsvoll erfolgt. Zudem ist ein Notbiwak grundsätzlich erlaubt."SAC, Merkblatt "Campieren und Biwakieren in den Schweizer Bergen", 2026 edition. A single considerate night by a small group above the treeline is normally unproblematic, and an emergency bivouac is allowed outright.

Note what that sentence is and is not. It is an ecological judgement from a club, and it is the sentence the internet has laundered into "above the treeline it is allowed in Switzerland", which is false almost everywhere. On the Hochstollen it happens to line up with the law, and that is a coincidence of Obwalden's legislature, not a rule you can carry to the next canton.8

And the Civil Code is not what makes this lawful either. Art. 699 opens forest and pasture to everyone in the local custom, and it is a right of access, never a right to spend the night. What makes this lawful is Art. 8.9

  • Just below the summit on the Frutt side, east of the ridge, for one night. Outside the rest zone on every probed bearing to 400 m, and squarely inside Art. 812.
  • Not on the west or south-west flank between 1 December and 30 April. That is the Gibel - Kleines Melchtal rest zone, legally binding, and it starts 38 m from the top3.
  • Not a second night in the same place. Art. 8 covers a single overnight stay; night two falls back under the Art. 6 ban1.
  • On the plateau: the signposted area at Talstation Balmeregg, one night, public toilet at the station. Anywhere else on the alp, the landowner has said in writing that they report it7.
  • Nowhere inside the Hutstock hunting-ban district, 4'483 m north-east, same commune. Free tenting and camping are federally banned there and consent does not help4.

General rules for wild camping

This list matters more where the answer is yes than where it is no. Obwalden's permission is narrow, conditional and one night long, and the only reason it holds here is that nothing on this summit gives anybody an interest to protect. Behave like that is true.

  • No fire. An open fire has no place in the mountains. A gas stove is enough.
  • Pitch late, strike early. Set up towards evening, gone again early. A bivouac is one night, not a base camp.
  • Leave no rubbish. Everything you carry up you carry down, organic scraps and toilet paper included.
  • At least 50 metres from any water for the big business, so you do not foul what people and livestock drink.
  • Stay small and quiet. A small group, no speaker, no drone, dogs on the lead, and the alp staff's word goes.

The verdict covers the summit area on the Melchsee-Frutt side and not the wildlife rest zone on the western flank in its protection period, not the Hutstock hunting-ban district, and not a self-chosen pitch on the Melchsee-Frutt plateau. Before every tour, check the current sources yourself and follow instructions on site. A genuine emergency bivouac in distress is a separate question from a planned camp. Frequently asked questions

Is wild camping allowed on the Hochstollen?
Yes, for one night, and by an express permission rather than a legal gap. Art. 8 of the Obwalden camping act (GDB 971.4, in force since 1 March 2015) allows a tent to be set up for a single overnight stay outside authorised campsites without a permit, as long as no public or private interests are impaired. The summit at 2'480.8 m carries no hunting-ban district, wildlife rest zone, BLN object, mire or floodplain. Pitch east of the top on the Melchsee-Frutt side and nothing else applies to you.
Do I need a permit, or anyone's permission?
No. Art. 8 says "ohne Bewilligung", without a permit, and Obwalden operates no consent regime of the Appenzell Innerrhoden kind where a tent needs the landowner's agreement by ordinance. Gemeinde Kerns restates the same rule on its own online counter and no stricter communal camping reglement exists. The one place on this mountain where permission would matter is the Hutstock hunting-ban district, and there even the landowner cannot give it, because the ban is federal.
Can I stay two nights?
No, and this is the sharpest limit in the article. Art. 8 is headed "Einmaliges Übernachten", a single overnight stay, and its wording repeats it. A second night is outside the exception and back under the general ban in Art. 6. Art. 11 punishes breaches of the act with a fine and expressly names whoever repeatedly breaches the camping ban outside a campsite. The act sets no franc amount, so treat any precise figure you read for Obwalden with suspicion.
What is the wildlife rest zone, and when does it actually stop me?
Gibel - Kleines Melchtal (Nr. 17.1), legally binding, 1 December to 30 April, boundary 38 metres west of the summit. Its rule is R70, an access ban away from the marked paths plus a leash requirement, so strictly it bans leaving the route rather than pitching a tent, but the effect is the same. Can I camp down on the Melchsee-Frutt plateau?
Only at the signposted area at the Balmeregg valley station, for one night. The plateau is a working alp with a named landowner, and the Alpgenossenschaft a.d.st. Brücke Kerns together with the commune, the corporation, the tourism association and the mountain railways published a joint position: Balmeregg is permitted, and breaches of the cantonal camping act elsewhere are reported by the landowner to the prosecuting authority. There is a public toilet at the station. A claimed "Zeltplatz Tannalp" has no evidence of operating in 2026 and this article does not send you there.
