Wild camping at the Nidersee: the commune banned the tent in 2023, and the landowner never got the memo
The request behind this article was one word: nidersee. It resolves to a single lake at 2'090 m in the Leitschachtal above the Arnisee, and to a four-page communal ordinance that almost nobody who walks up here has read.
What do these mean?
Illegal A specific rule bans it, usually with a fine, and it can be enforced. Sleep somewhere else.
Not allowed No real place to camp here. A gated site, a developed area, or nowhere sensible to lie down, even if no fine is attached.
It depends You can sleep here, but there's a condition first: ask the landowner, book a spot, stay inside a set zone, or use a bivvy instead of a tent. The report says which.
Tolerated No rule clearly allows or bans it, but a single night is accepted in practice and nobody enforces against it. Normal for high bivouacs above the treeline.
Legal Camping one night is fine here. Either a rule allows it, or we checked every law and found nothing against it. Still: pitch late, leave early, no trace.
Gurtnellen banned the tent across the whole commune, and it is only two years old
Canton Uri writes no camping rule at all, which is why people arrive here relaxed. There is no cantonal wild-camping prohibition, and on 11 November 2025 the Regierungsrat turned down a parliamentary motion for one as disproportionate. The interesting part is the list in its own answer: the communes that do have their own rules are named as Göschenen, Gurtnellen, Andermatt, Hospental and Realp. This lake sits in the second of them.4
The instrument is the Verordnung über Camping in der Gemeinde Gurtnellen, adopted by the Gemeindeversammlung on 24 May 2023 and signed by Gemeindepräsidentin Verena Tresch and Gemeindeschreiberin Jessica Walker. Four pages. Article 1 sets the scope, and the scope is the whole commune: "Diese Verordnung regelt auf dem Gemeindegebiet ein geordnetes Campieren sicherzustellen und zu verhindern, dass die öffentliche Ruhe, Ordnung, Sicherheit und Sittlichkeit gestört oder Orts- und Landschaftsbilder beeinträchtig werden." No altitude threshold, no zone carve-out, no distinction between the valley floor and an alp at 2'090 m.2

Erecting tents, caravans, motorhomes and camper buses for camping outside authorised camping or parking places is not permitted. That is the operative sentence, and a hiker's tent on the shore of the Nidersee is squarely inside it. There is no reading of article 2 under which a pitched tent up here is lawful without a permit.2
The money is modest and it is communal. Article 12 reads: "Bei Widerhandlungen der Verordnung kann eine Busse von bis zu Fr. 200.00 erteilt werden." Up to two hundred francs, and note "kann", may, so it is a discretionary ceiling rather than a ticket with a printed price. The listed cases are camping without a permit, breaching the conditions of a permit, and repeatedly breaching the ban outside a Camping- or Stellplatz. The authority that acts is the commune, not the canton and not the Confederation.2
One number you may have seen elsewhere does not belong here. Uri's fixed-penalty catalogue carries CHF 150 for camping, but only inside a protection zone whose own reglement forbids it, and there is no such zone at this lake. Why not is the fourth section below.4
The ordinance never uses the word bivouac, and that is the whole opening
Read the text for what it counts rather than for what it feels like. A word-boundary scan of the full 5'330 characters of the ordinance returns Zelt four times, campier five, Camping fifteen, Wohnwagen twice and Wohnmobil once. It returns Biwak zero times. The document that governs sleeping outdoors in this commune never names a bivouac, in any form, anywhere in its four pages.2
Now look at the verb. Article 2 does not prohibit spending the night, or lying down, or staying. It prohibits das Aufstellen, the erecting, and it attaches that verb to a closed list of things you put up: tents, caravans, motorhomes and camper buses. Nothing is erected in a bivvy bag. Swiss criminal law is read literally and not by analogy, so a norm that bans erecting a device does not silently grow to cover a person lying on a mat with no device at all. Article 12 letter a's shorthand, whoever camps without a permit, cannot enlarge article 2 either, because the penalty is parasitic on a breach of the ordinance itself.2
This is not a reading invented for this article. Göschenen, one valley to the south, passed an almost word-identical Campingverordnung on 29 April 2022, and this journal graded the Göscheneralp as restricted rather than forbidden on exactly this reasoning. A cantonal appellate decision points the same way: the Obergericht of Graubünden held in February 2026 that Campieren is narrower than Übernachten and does not cover biwakieren. That was a Graubünden case on a Graubünden text, so it binds nobody in Uri, but it is the same argument reaching the same place.2
And here is the honest limit, which matters more than the argument. Nobody has litigated the Gurtnellen ordinance. No enforcement case involving a hiker turned up anywhere in the commune, at this lake or elsewhere, and the 2023 vote was reported locally as a measure against motorhomes rather than against walkers. A Gemeinderat that wanted to read article 2 broadly could argue that a bivvy bag is camping in substance, and you would be the test case. That is why the verdict here is "it depends" and not "yes".
The landowner says yes, and it changes nothing
This is the trap on this pin, and it is worth saying plainly. Korporation Uri, the corporation that owns the great majority of Uri's alps and forests, publishes a page on wild camping, and it reads like a green light: "Im Kanton Uri besteht kein generelles Verbot für Wildcamping. Auf Gebiet der Korporation Uri ist das Campieren somit grundsätzlich erlaubt und muss nicht angemeldet werden." No general ban in the canton, so camping on Korporation ground is in principle allowed and does not need to be notified.5
Its list of closed areas names Göschenen and the Seewlisee, and stops there. Gurtnellen is not on it. The ordinance that governs this lake was passed in May 2023, and the landowner's page has not caught up with it. So a reader who checks the owner and stops is left with a permission that the commune has since overridden.5
The rule underneath is the one to remember, and it travels far beyond this lake. Consent from whoever owns the ground removes the private-law objection, trespass. It does nothing at all to a communal ordinance, which is public law and binds everyone on the territory regardless of who holds the title. When the owner says yes and the commune says no, the commune wins. Korporation Uri, Gotthardstrasse 3, 6460 Altdorf, 041 874 70 90, is still the right call for the private side and for its own conditions, which are sensible: spare the pasture, private roads need a permit, speak to the Älpler near a working alp, notify above three nights or ten people, carry everything out.5
Who owns this particular ground is not publicly established, and I am not going to guess. Uri publishes no parcel owners. What is established is that the pin sits inside an alp perimeter: Alp no. 1209/54/1, "Leitschach Schafalp", Weideart Kleinviehweide, 18'192 Aren. A sheep alp, which is why there is no Sennhütte and no cheese sale up here. Korporation Uri is strongly indicated as the owner, since it holds the water rights on the Leitschach- und Intschialpbach, but indicated is not proved. The tenant is a blank too: the Urner alp guide profiles the neighbouring alps with names and numbers and lists Leitschach in the index only. No customary payment for camping is documented anywhere in this valley, by anyone, so if you meet the Älpler, ask, and do not arrive with a figure someone on the internet invented.6
The Maderanertal reglement does not reach this lake, so the CHF 150 does not either
People reach for this one, and the reason is geography. The Fellital lies in the commune of Gurtnellen, and the cantonal Reglement über den Schutz der Region Maderanertal und Fellital, RB 10.5111, does forbid tenting and camping in two of its inner zones. If your pin is in Gurtnellen, it is easy to assume the reglement is what governs it. At the Nidersee it does not, and the answer holds up from three independent directions.3
First, the two datasets, each with its own control. The Uri cadastre layer that carries the reglement returns no feature at the lake, while in the same run it returned the boundary object with the reglement and its Regierungsrat decisions at three points known to be inside, the Golzernsee, the Chärstelenbach and the Fellital; an invalid layer name returned a service exception rather than an empty result, so the layer really does answer. The public-law restrictions extract for parcel 703, about 16 megabytes, contains zero occurrences of 10.5111, Maderanertal or Fellital, where a control parcel inside the perimeter in Silenen carries all three more than a hundred times over.3
Second, the reglement's own boundary. Article 2 lists the outer perimeter by named points and closes it "entlang Reuss", along the Reuss, and the annex plan draws the line coming down into the Reuss valley. The Nidersee sits about 2.5 km west of the Reuss, in the Leitschachtal on the Arni side, with the nearest perimeter edge roughly 5.0 km to the south-east. A word-boundary scan of the whole reglement finds Leitschach, Leutschach, Arni, Nidersee, Obersee and Intschi not once.3
Which settles the money question. Uri's Reglement über die Erhebung von Ordnungsbussen, RB 3.9223, sets CHF 150 at no. 2.1 for "Lagern, Zelten oder Campieren in Schutzzonen", and the parenthesis makes the dependency explicit: article 34 paragraph 1 letter a of the cantonal Natur- und Heimatschutzgesetz RB 10.5101 in conjunction with the relevant reglement. No protection zone here, no reglement to conjoin, no CHF 150. The figure at the Nidersee is the communal CHF 200 of article 12.4
One thing at this lake does look alarming and is not. The Nidersee is itself in the cantonal protection inventory, object NO.1209.08, significance local, in force since 4 July 2017 and anchored in the Bau- und Zonenordnung of Gurtnellen. Its goal is "Erhalt des Sees und dessen natürlicher Umgebung", and its single protection measure reads, in full, "Keine Veränderung der Bodenoberfläche": no alteration of the ground surface. The zoning code glosses terrain alteration as excavation, filling, deposits and extraction. That is a works rule about earthworks, not a camping rule, and the lake is registered as an object rather than as a Schutzzone, so the fixed-penalty line has nothing to attach to there either.7
And the federal layers are empty. Queried at the pin with a positive control and an invalid-layer control in the same runs: no game reserve, the nearest being Fellital 3'927 m away; no wildlife rest zone, the nearest 8'187 m off and shut only from December to April; no BLN, Maderanertal und Fellital beginning 4'720 m away; no floodplain, mire, moor landscape, amphibian site, Emerald site, forest reserve or park. Nothing federal touches this shore.1
The map pin is on open water, and the hut is 220 metres away
Start with a correction to the map. The coordinate this place resolves to, 46.781830 / 8.600215, is not on land: it sits 23.7 m inside the lake polygon, which is ordinary behaviour for a gazetteer entry naming a body of water. The terrain model says the same thing without ambiguity, because nineteen height samples inside that polygon all return exactly 2'090.5 m, minimum equal to maximum, a perfectly flat plane. That is water, not a bench, and every slope figure below is measured with the lake masked out. The lake is about 215 m by 91 m, 128 Aren by the inventory sheet.1
Water-masked, on a 25 m grid over a 700 m square, there is real ground for a night, and it is not at the water's edge:
- East side, near the outflow. LV95 2'688'890 / 1'181'882, about 2'087 m, slope 4.0 degrees, roughly 70 m back from the shore and 193 m east of the pin. The most usable ground measured anywhere in the box.
- West bench. LV95 2'688'540 / 1'181'807, about 2'100 m, slope 5.3 degrees, roughly 68 m from the water and 165 m west of the pin.
- Two more, further out: 6.8 degrees at 2'096 m, 126 m south-west and only 28 m from the shore, which is the closest thing to the water worth calling flat; and 2.3 degrees at 2'195 m, 316 m south-east and a proper walk from the lake.
So the honest summary is: the place takes a tent, but not on the shoreline. Nothing usable sits closer than about 30 m to the water, which happens to line up with the way you should be treating a small alpine lake anyway. The zoning at all of these points is Reservezone, unproduktiv, a non-building zone whose article regulates buildings and installations and imposes no rule of conduct on a person. The pin itself is zoned Gewässer, water, and that entry is marked informative rather than binding.7
Height is not the problem here. At 2'090 m this is comfortably above the treeline: no forest layer at the pin, the nearest static forest boundary 3'524 m away, open alp on the inventory sheet. The Alpine Club's position, that a single considerate night by a small group above the treeline is normally unproblematic, would fit this ground exactly if there were no communal ordinance. There is one, which is the entire point of this article.9
Now read the room, because the map does not show it. The Leutschachhütte SAC stands 220 m north-north-east of the lake at 2'208.7 m, and the flattest patch anywhere in the measured box, 0.9 degrees, is essentially the hut's own terrace. This is not an empty basin: it is a hut basin, section SAC Zimmerberg, 60 places plus a six-place winter room, serviced mid-June to mid-October, with a climbing garden and a raft at the Obersee 451 m to the north-north-west. A tent on the shore is in full view of the warden's window. That does not change the legal answer, but it does change the sensible one.8
Getting here is on foot and nothing else. The valley is roadless. Standard approach, SAC grade T2: cable car from Intschi or Amsteg to Arni at 1'368 m, then the track to Torli and the path up the Leitschach past Chäserli, Bidemli and Leutschach to the lake. About 6 km, 700 to 850 m of ascent, around two and a half hours, a few switchbacks more to the hut. The lower Leitschach is working farmland along the Leitschachbach, so expect stock and gates, and some local pages spell the valley Leutschachtal.8
Three lawful nights here, in order of realism
One: the hut, 220 metres away. This is the boring answer and it is also the right one for most people, because the bed exists, it is close, and it needs no legal argument. Leutschachhütte SAC, section Zimmerberg, 2'208 m, 60 places plus a six-place winter room that is open all year, serviced mid-June to mid-October and closed from November to May. Warden Andrea Furrer, hut telephone 041 883 15 17. Reservation is described as mandatory. The warden is also the right first call if you are thinking about a tarp by the lake: she knows the ground, the alp and the commune better than any map layer does.8
Two: a tentless bivouac, on the reading in the second section. No tent, no structure, nothing erected. Up at dusk, gone at first light, well back from the water on the ground described above, and out of the hut's approach. This is a narrow lane through the wording of article 2, not a permission, and if a Gemeinderat ever reads its own ordinance more broadly you would be the case that tests it. Treat it accordingly and keep it invisible.2
Three: ask, in writing. Article 3 paragraph 1 of the ordinance lets the Gemeinderat permit exceptions. Letters a and b cover youth tent camps and organisers of large events for at most four event days, and letter c is deliberately open: in anderen begründeten Ausnahmefällen, in other justified exceptional cases. Paragraph 2 adds that an exception must not impair public or private interests. The address is Gemeinderat Gurtnellen, Dorfstrasse 6, 6482 Gurtnellen, 041 885 11 07, gemeinde@gurtnellen.ch. Whether a single hiker has ever been granted one is untested, and no fee for it is published anywhere. It costs a letter to find out, and a written yes is worth more than any reading of a verb.2
What the ordinance does offer, it offers to vehicles. The one authorised place in the commune is the Stellplatz Geisssticki on the Reuss at Gurtnellen-Wiler, thirty pitches at about CHF 20 a night, 5.6 km away and 1'400 m below the lake. The lawful answer for a camper van, no answer at all for someone walking up the Leitschach. Tourist tax is not an issue either way: the communal reglement exempts guests who stay free of charge, and a night in the hut carries CHF 1.50 of it.6
Finally, where this stops, because you should know. There is no enforcement case on record: no fine against a hiker anywhere in Gurtnellen, and the 2023 ordinance was reported locally as a motorhome measure. No trip report, forum post or photo caption documents anyone sleeping outdoors at the Nidersee; every account treats it as a day walk to the hut. And no page, tourism or communal, carries a request not to camp here, in either the binding or the please-refrain register. Fire, for the record, is a stove and nothing else on a sheep alp above the treeline. The only thing at this lake that binds you is the ordinance, and now you have read it.68
General rules for wild camping
The list below is not the law. It is what keeps a tentless night here quiet enough that nobody has to decide whether it was camping, and every item on it is something you can check yourself before you go.
- No fire. An open fire has no place in the mountains. A gas stove is enough.
- Pitch late, strike early. Set up towards evening, gone again early. A bivouac is one night, not a base camp.
- Leave no rubbish. Everything you carry up you carry down, organic scraps and toilet paper included.
- At least 50 metres from any water for the big business, so you do not foul what people and livestock drink.
- Stay small and quiet. A small group, no speaker, no drone, dogs on the lead, and the alp staff's word goes.

- Korporation Uri, pages "Wildcampieren" and "Grundeigentum", read 1 September 2026. Quoted verbatim: "Im Kanton Uri besteht kein generelles Verbot für Wildcamping. Auf Gebiet der Korporation Uri ist das Campieren somit grundsätzlich erlaubt und muss nicht angemeldet werden." Its conditions: respect protection zones, spare the pasture, private roads need a permit, contact the Älpler near a working alp, notify above three nights or ten people, carry out all waste in fee bags, leave the place clean, no liability for damage by weather or livestock. Its list of banned areas names only Göschenen and the Seewlisee, so it has not been updated for the Gurtnellen ordinance of May 2023 in source 2. This is a landowner's permission and not a norm: it removes the private-law objection and leaves a communal public-law prohibition untouched. The Grundeigentum page names the "Leitschach- und Intschialpbach" among the watercourses on which the Korporation holds water rights and states that the great majority of Uri's alps and forests belong to the Korporationen, which makes it the likely but unproven owner of parcel 703; Uri publishes no parcel owners. There is also a Korporationsbürgergemeinde Gurtnellen, whose fee ordinance covers permits to drive four named alp roads, none of them the Leitschach approach, which is a footpath. - Gemeinde Gurtnellen, Rechtssammlung and land use, every published act word-boundary scanned for zelt, campier, camping, kampier, lager, biwak, übernacht, nächtig, wohnwagen, wohnmobil and schlafen, with article and Gemeinde counts as controls. Silent on camping: Bau- und Zonenordnung (72'544 characters, 195 articles, zero camping terms; its six occurrences of "lager" are Lagerplatz, Materiallager, Zwischenlagerung, Lagerräume and Ablagerung; Art. 21 zones the ground around the lake as Reservezone, unproduktiv, and Art. 24 Abs. 2 glosses Terrainveränderungen as "Abgrabungen, Aufschüttungen, Materialablagerungen, Materialabbau und dergleichen"), Gesamtrevision Nutzungsplanung RRB 2017-410, Gemeindeordnung 2024, Verordnung über den Feuerschutz, Hundereglement 2024, Gebührenordnung Räumlichkeiten 2024 and the Gebührenverordnung Korporationsbürgergemeinde 2019. Two acts arrived as scans with 18 and 2 characters of extractable text, the Wasserversorgung and its Tarifordnung, and were OCR'd rather than reported as silent: 28'466 and 3'050 characters, zero camping terms. Kurtaxenreglement 2025: Art. 2.4 exempts guests who overnight free of charge, and Art. 3.5 names the Stellplatz Geisssticki with an annual flat rate of CHF 1'500. The Stellplatz itself, Gotthardstrasse 14, 6482 Gurtnellen-Wiler, 30 pitches at about CHF 20 a night, is the only authorised place in the commune, 5.6 km from the lake and about 1'400 m below it. That is a works prohibition about earthworks, not a camping rule, and the lake is registered as an object rather than as a Schutzzone, so the fixed-penalty tariff in source 4 has nothing to attach to. Restrictions whose polygon actually contains the pin: the communal land-use plan, zone "Gewässer" (Ge), marked hinweisend, informative only; and two overlapping Gewässerschutzbereich polygons, which regulate installations and discharges rather than sleeping. Nearest by theme: local nature protection point 9.1 m (this object), communal land use 19.6 m, water protection 33.4 m, national and regional protection lines 138 m, local nature protection area 2'666 m, noise sensitivity 748 m, Gewässerraum 2'635 m, static forest boundary 3'524 m, groundwater protection zones 3'680 m, so no S1 or S2 anywhere near. The Line restrictions 138 m away are the protected watercourses of RB 10.5118, whose Art. 2 Abs. 3 states "Schutzobjekt ist jeweils nur das eigentliche Gewässer. Hut at 2'208.7 m, 220 m north-north-east of the lake, with two further buildings at 278 m and 283 m; 60 places plus a six-place Winterraum open year round; serviced mid-June to mid-October and closed November to May; warden Andrea Furrer, hut telephone 041 883 15 17; reservation described as mandatory. Neighbouring huts: Sunniggrathütte 2.6 km, Treschhütte SAC 8.0 km. Access, SAC grade T2 and roadless: cable car from Intschi or Amsteg to Arni at 1'368 m, then the track to Torli at 1'383 m and the path up the Leitschach past Chäserli, Bidemli and Leutschach to the lake at 2'090 m, about 6 km, roughly 700 to 850 m of ascent, around 2.5 hours, with a few more switchbacks to the hut; the lower valley is working farmland along the Leitschachbach. A climbing garden and a raft sit at the Obersee 451 m north-north-west. Destination-page check, both registers: the general Uri tourism page on wild camping names only the Seewlisee as prohibited and then links the Merkblatt Camping Urserntal and the Campingverordnung Gemeinde Gurtnellen, which is a pointer to law rather than a request. The per-area pages for this valley, Gurtnellen Tourismus on the Täler und Alpen, the commune's Arnisee page, the SAC tour "Vom Arnisee über Nidersee", Schweizer Wanderwege, Bergwelten, Famigros and schweizersee.ch, say nothing at all about camping, tents, bivouacking or overnight stays outdoors, and none carries a please-refrain request. The only overnight instruction anywhere in the valley is the hut's own "Anmeldung zwingend". And: "Übernachte nicht zu nahe bei Hütten und beweideten Alpen oder erkundige dich, ob eine Übernachtung in der Nähe möglich ist", which at this lake is not an abstraction: the hut is 220 m away and the ground is a sheep alp.
